Family Law Mediation

Mediation Services in Children’s Matters In most parenting matters, it is compulsory to attend Family Dispute Resolution (‘mediation’) before applying to the court for parenting orders.

الخيارات الثنائية ما هم Mediation is a process where two or more people are assisted by a neutral third party to resolve the issues between them. A mediator will facilitate discussion between the parties so that they can hopefully reach a mutually acceptable outcome.

There are many benefits to mediation. These include:

  • If you reach agreement, you have a resolution much earlier than if the matter proceeds to court.
  • You can have a strong voice in the outcome, rather than having orders imposed on you by the court.
  • You can save a substantial amount in legal fees.

When a person contacts us about Family Dispute Resolution, we organise to speak to both parties to:

  • Give each party more information about the mediation process so they can decide if it is right for them
  • Allow the mediator to assess whether the matter is suitable for mediation and customise the mediation process to suit all parties
  • If the matter is suitable for mediation, prepare for the mediation session

If the matter is not suitable for mediation, or if one party refuses to attend, then a section 60I certificate can be issued.

If the matter is suitable for mediation, then a mediation session will be arranged. During a mediation session, all parties will be given an opportunity to speak about the issues they wish to discuss. The parties can identify options for resolving the dispute between them. If an agreement is reached, the parties can discuss how they want to record and implement that agreement. How long does it take?

The length of individual mediations will vary but typically may take between 2-4 hours. Some mediations will not take that long and others may need more time depending on how many issues the parties wish to discuss. If more time is needed, we can offer the option of a second mediation session on another day rather than going beyond the 3-4 hour mark. Mediations can be highly emotional and stressful as they centre around the most important people in your life. Sometimes it can be beneficial to take some time and come back to a second mediation after everyone has had time to rest and reflect.


go here Do I have to bring a lawyer?

There is no requirement to attend mediation with your lawyer. We have many people attend mediation by themselves. Other people prefer to bring a professional such as a lawyer. If you want to attend mediation with your lawyer or any other kind of support person, then we ask that you raise this with us during intake so we can discuss it further with you.

Unless otherwise agreed between the parties, the person who initiates mediation is charged an intake assessment fee of $220 (including GST).

If the matter is deemed unsuitable for mediation, then no further fees are charged.

If the matter is deemed suitable for mediation, then the parties are asked to share equally the fees for the mediation session. The mediation session costs $275 per hour (including GST). You will be charged for a minimum of 2 hours. If the mediation takes longer than 2 hours, you will be billed to the nearest half hour.

If the parties reach an agreement, we can draft that agreement in the appropriate form. This is charged at $275 including GST per hour and will be billed to the nearest half hour. We also ask that the parties share equally in this fee.

We can issue separate invoices to each party.
